OFFICIAL RULES & REGULATIONS

FOLEY EQUIPMENT COMPANY 2025 WINTER PHOTO CONTEST

NO PURCHASE IS NECESSARY TO ENTER. YOUR CHANCES OF WINNING DO NOT INCREASE WITH A PURCHASE.

  1. Eligibility: The Foley Equipment Company 2025 Winter Photo Contest (“Contest”) is open to owners or users of Cat® branded equipment who have purchased or rented equipment or other items from, or utilized the services of, Foley Equipment within the last five (5) years. This Contest is subject to federal, state, and local laws and regulations and void where prohibited by law. Entrants must be at least 18 years of age and legally able to enter into an agreement in order to qualify.
  2. Sponsorship: The sponsor is Foley Equipment Company (“Sponsor”), located at 1550 S. West Street, Wichita, KS 67213, USA. Sponsor will conduct the Contest substantially as described in these Official Rules.
  3. Agreement to Rules: By entering the Contest, You (the “Entrant”) agree to abide by the Sponsor’s Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering a photo in the Contest, the Entrant represents and warrants that they are eligible to participate based on eligibility requirements explained in the Official Rules. The Entrant also agrees to accept the decisions of the Sponsor as final and binding as it relates to the content of the Contest.
  4. Entry Period: The Contest entry period begins on November 1st, 2025, at 6:00AM CST and ends on December 26th, 2025, at 5:00PM CST (“Entry Period”). To be eligible for this Contest, entries must be received by Sponsor within the specified Entry Period.
  5. How to Enter: Eligible Entrants can enter the Contest by submitting a photo (“Entry”) via the online form provided at https://www.foleyeq.com/resources/offers-promotions/2025-photo-contest/. In order to be eligible to win a prize, all Entries must fully meet Contest requirements, as specified in the Official Rules. Incomplete Entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor’s sole discretion.

All Entries must feature Cat® branded equipment in good working condition being used within Foley Equipment’s operational territory. Under no circumstances will an entry depicting obviously unsafe working conditions or poorly maintained equipment; bearing branding of dealers other than Foley Equipment; or clearly taken outside of Foley Equipment’s operational territory be accepted. Additionally, Entries must not contain the animal cat (felines) or a caterpillar bug (insects) as the focus of the image. Entries must not be divisively political in nature and must not display visible profanity or other forms of offensive non-protected speech in the image.

Entrants may enter as many Entries as desired but may only be selected to win once (regardless of the number of times entered). Fraudulent methods of entry or circumvention of the rules may result in the Sponsor invalidating that Entry and all other Entries by the Entrant and removing them from the Contest at the Sponsor’s sole discretion.

  1. Prizes: The winner(s) of the Contest (the “Winner”) will receive a 55qt Cat Cooler with a retail value of approximately $350 (the “Prize”). The actual/appraised Prize value may differ at the time the Prize is awarded. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The Winner, upon acceptance of the Prize, is solely responsible for all expenses related to the Prize, including without limitation any and all local, state, and federal taxes. The Winner shall not transfer or assign the Prize to others, nor shall the Winner request the cash equivalent or Prize substitution.
  2. Odds: The odds of winning depend on the number of eligible entries received.
  3. Selection and Notification of the Winner: The Entry photo with the most “likes” on the Foley Equipment Facebook page as of 5:00PM CST on Friday, December 26th, 2025 (as viewed by the Sponsor) will determine the Winner. In the event of an equal number of “likes” on two or more Entry photos submitted by different Entrants, multiple winners may be selected in Sponsor’s sole discretion. The Winner(s) will be announced on Facebook at the time of selection. The Sponsor will notify the Winner(s) by email within ten days following end of entry period. The Sponsor is not responsible for nor shall have any liability for a Winner’s failure to receive notices for any reason, including due to email security settings that may cause notifications to be marked as spam or junk email, nor shall the Sponsor be liable for the Winner’s provision of incorrect or otherwise non-functioning contact or delivery information. If the Winner fails to claim the Prize within 30 days from the time the award notification was sent or is found ineligible, the Prize may be forfeited and an alternate Winner may be selected. Receipt of the Prize by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations.
  4. Rights Granted by the Entrant: By submitting an Entry into this Contest, Entrants understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees, successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute, and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation by Entrant (or any other person or entity whether depicted in the Entry or not) the Entrant’s Entry, name, photo, portrait, voice, likeness, image, statements about the Contest, and the Entrant’s biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration. Entrant agrees to indemnify and hold Sponsor harmless from and against any claims to the contrary, including reasonable attorney fees incurred to defend against such claims.
  5. Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the Contest should unauthorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control impact or corrupt the security, fairness, proper conduct, or administration of the Contest.
  6. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Sponsor website.
  7. Winners List: Anyone may obtain a copy of the Winner’s name(s) or a copy of these Official Rules by sending a request via mail with a stamped, self-addressed envelope to: Foley Equipment, ATTN: Marketing, 1550 S. West Street, Wichita, KS 67213, USA. Requests must be postmarked no later than December 26th, 2025 (5:00PM CST). 13. Social Media Platform Rules: The Contest is sponsored by Foley Equipment Company and is in no way sponsored, endorsed, administered by, or associated with Facebook™, Meta™, Caterpillar, Inc.® or any person or entity affiliated with such entities.
  8. Affirmation of Acceptance of and Agreement to All of the Official Rules: By entering the Contest at https://www.foleyeq.com/resources/offers-promotions/2025-photo-contest/, the Entrant is affirming that they have reviewed, accepted, and agreed to the Official Rules.
